Optimyze Terms of Service

These Terms of Service govern your access to and use of the Optimyze mobile application, website located at optimyzeapp.com, and all related products, features, tools, content, functionality, and services. The Services are owned and operated by Joseph Bye.

You must be at least 13 years old to use the Services. If you are under 18, you represent that you have obtained permission from a parent or legal guardian.

Optimyze is a financial wellness platform designed to help users understand and improve financial habits through budgeting tools, cash flow tracking, Financial Fitness Scores, personalized goals, debt simulations, educational content, and related features. Certain features, including personalized coaching recommendations, are generated using third-party artificial intelligence technology. AI-generated content is provided for informational purposes only, may not always be accurate or complete, and should not be relied upon as professional financial, investment, legal, or tax advice.

Optimyze is not a bank, lender, investment adviser, accountant, attorney, or financial institution. All information and recommendations are provided solely for informational and educational purposes.

Users must provide accurate information, maintain account security, and accept responsibility for activity occurring under their account.

Optimyze uses Plaid Technologies, Inc. to facilitate financial account connections. Optimyze does not store banking usernames or passwords and cannot transfer funds or conduct transactions on behalf of users.

Paid subscriptions may be offered. Pricing, billing frequency, and renewal terms will be disclosed at purchase. Payment will be charged to your Apple ID account (or applicable app store account) at confirmation of purchase. Subscriptions automatically renew for the same subscription period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, and you will be charged the renewal price then in effect. You can manage or cancel your subscription at any time by going to your Apple ID account settings (Settings > [your name] > Subscriptions on iOS) after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Users may not violate laws, impersonate others, access unauthorized accounts, reverse engineer the Services, scrape data, upload malware, or interfere with platform operations.

All software, branding, logos, content, Financial Fitness Score methodology, and related intellectual property are owned by Optimyze or its licensors.

Users retain ownership of content they submit while granting Optimyze a limited license to store, process, analyze, and display such information to provide and improve the Services.

The Services may integrate with Plaid, Supabase, Apple, Google, analytics providers, and payment processors. Optimyze is not responsible for third-party services.

If you access the Services through the Apple App Store, you acknowledge and agree that: (a) this Agreement is between you and Optimyze only, and not with Apple Inc. ("Apple"), and Apple is not responsible for the Services or their content; (b) Apple has no obligation to furnish any maintenance or support services for the Services; (c) in the event of any failure of the Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, and to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Services; (d) Apple is not responsible for addressing any claims by you or any third party relating to the Services, including product liability claims, claims that the Services fail to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation; (e) Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party claim that the Services infringe that third party's intellectual property rights; (f) you will comply with applicable third-party terms of agreement when using the Services; and (g) Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

Services may be modified, suspended, updated, or discontinued at any time. Uninterrupted access is not guaranteed.

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, Optimyze shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages. Total liability shall not exceed the greater of $100 or the amount paid by the user during the previous twelve months.

Users agree to indemnify and hold harmless Optimyze, Joseph Bye, employees, contractors, and affiliates from claims arising from use of the Services.

Optimyze may suspend or terminate accounts for violations of these Terms, legal requirements, or protection of the Services and users.

Use of the Services is governed by the Optimyze Privacy Policy.

Updated Terms become effective when posted. Continued use of the Services constitutes acceptance of revised Terms.

These Terms shall be governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in Florida courts.

If any provision is determined unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy and incorporated policies, constitute the entire agreement between users and Optimyze.
